General Terms and Conditions of Car Rental Ph (CRP)

 

1. Reservation / Booking

To reserve a vehicle with Car Rental Ph (CRP), the following requirements must be met:

• Full Name
• Address (Hotel or Condo acceptable)
• Contact Number(s)
• At least two (2) valid IDs or Passport
• Proof of Billing (Hotel Invoice, Credit Card Statement, Utility Bill, etc.)
• Payment of a refundable reservation deposit of ₱3,000

Upon submission of the required details, CRP will issue a provisional confirmation note. Final confirmation is granted only upon receipt of the ₱3,000 reservation deposit. If requirements remain incomplete, CRP reserves the right to release the vehicle to another customer without notice.

By completing full payment online and receiving the final confirmation, the customer is guaranteed the booked vehicle or service. If the specific vehicle is unavailable, CRP will provide an equivalent alternative or a free upgrade.

The renter agrees that by making the reservation online, they accept and agree to these terms and conditions. Non-signing or non-acceptance of these terms during the car handover is not a valid reason for a refund, and the cancellation policy will apply.

3. Cancellation & No-Show Policy

Cancellation and no-show fees apply as follows:

• 30+ days before rental: Free, except for the reservation deposit.
• 15 – 30 days before rental: 25% of total rental or deposit, whichever is higher.
• 8 – 14 days before rental: 50% of total rental or deposit, whichever is higher.
• 7 days or less / No-Show: 100% of total rental or deposit, whichever is higher.

A minimum cancellation fee of ₱3,000 applies. Refunds are not provided for cancellations due to “change of plans,” “flight delays/cancellations,” “quarantine,” etc.

A “No-Show” occurs when the renter fails to pick up the vehicle within 30 minutes of the agreed time without prior notice. CRP may accommodate delays if properly informed; otherwise, the booking will be forfeited.

3. Vehicle Classifications

Customers may book a vehicle class but are not guaranteed a specific make, model, type, or color. CRP reserves the right to provide a similar or upgraded vehicle at no extra cost.

4. Rental Terms

• Rentals begin and end at the agreed pickup and return time.
• Early returns: No refunds.
• Late returns: A penalty of ₱350 per hour applies after the agreed return time. Delays beyond 3 hours result in a full-day rental charge plus compensation for lost bookings.
• Pickup/Return Location: Casuntingan, Mandaue. Failure to return the vehicle at the designated location results in forfeiture of the deposit and additional retrieval fees.
• Minimum rental: 2 days (self-drive) or 3 days (during holidays). Rentals shorter than this period will be charged for the minimum duration.

5. Scope of Use

The renter agrees to use the vehicle solely for personal or business purposes on properly maintained roads.

Prohibited Use:

• Subleasing the vehicle or using it as a taxi.
• Taking the vehicle outside Cebu & Mactan Islands (e.g., Bantayan Island).
• Using the vehicle for racing, driving tests, or off-road driving.

Out of Island Use: The vehicle may be used on Cebu Island, Mactan Island, and Bantayan Island without penalty. For any other islands, the renter must book the out of Cebu option and obtain prior written agreement. If the vehicle is used outside the approved areas without permission, a penalty of ₱2,000 per day applies.

Violations incur a ₃,000 per day penalty, and legal action may be pursued. CRP vehicles are equipped with GPS tracking to prevent unauthorized use.

6. Mileage Policy

• Unlimited mileage unless specified during booking.
• Special offers may include a 50 km/day limit; excess mileage costs ₱12 – ₱25/km, depending on the vehicle.
• Short-term rentals (<3 days) have a 100 km/day limit, with additional charges for excess mileage.

7. Rental Fees & Additional Charges

• Fuel: Renters must return the vehicle with the same fuel level. Otherwise, a ₱400 per missing level charge applies.
• Cleaning: A ₱500 cleaning fee applies if the vehicle is returned dirty. Stain removal costs ₱2,000 per stain.
• Smoking Prohibited: A ₱3,000 penalty applies for odor removal due to smoking inside the vehicle.

8. Security Deposit

• A ₱3,000 security deposit is required.
• This deposit covers damages, penalties, or lost accessories.
• If damages exceed the deposit, the renter must pay the balance.

9. Insurance Coverage

• Vehicles include CTPL insurance covering third-party liability and personal injury.
• The renter is responsible for insurance deductibles.
• Exclusions: Tire/rim damage, interior damage, and negligence-related incidents are not covered and must be paid in full.
• Vandalism & Theft: The renter is fully liable for any damages arising from vandalism, theft, or any other events occurring during the rental period, including those covered by insurance, but which are subject to the renter’s responsibility.

10. Indemnification

The renter agrees to indemnify and hold CRP harmless against any claims, losses, or damages resulting from vehicle use, including legal fees.

11. Jurisdiction

All disputes shall be governed by Philippine law and settled in Cebu City, Region 7, Central Visayas.

12. Entire Agreement

This document constitutes the full rental agreement. Any modifications must be in writing and signed by both parties.

13. Force Majeure

CRP shall not be held liable for failure or delay in fulfilling any of its obligations due to unforeseen circumstances beyond its control, including but not limited to natural disasters, government actions, strikes, pandemics, or any other force majeure event.

14. Non-Disclosure Agreement (NDA)

The renter acknowledges and agrees not to disclose any details of this agreement, including vehicle condition, pricing, and other private business information. A breach of this NDA may result in a penalty of up to ₱10 million and legal actions, including lawsuits for cyber libel, defamation, and any other potential legal actions.

15. Penalties for Traffic Violations and Offenses

Any penalties for speeding, violation of traffic laws, parking offenses, or other legal infractions incurred during the rental period will be charged to the renter’s account. Additionally, a supplementary service charge of ₱1,000 per penalty will apply.

16. Rental Condition Confirmation

The renter confirms that the vehicle has been received in good condition, as per the protocol signed by them during the car handover. The vehicle is confirmed to be clean and odor-free, considering the tropical climate of the region. Any personal sensation of moldy, cigarette, or other odors after the car handover will not be grounds for replacement or cancellation. CRP will not be held responsible for such claims once the vehicle has been taken over by the renter.

17. Recording / Documentation Clause

The renter acknowledges that CRP reserves the right to record and document all communications and transactions related to the rental process. This includes but is not limited to, online booking confirmations, phone calls, emails, and other interactions. The renter consents to this and acknowledges that such recordings may be used for dispute resolution or legal purposes as deemed appropriate by CRP.

18. Refunds and Security Deposit

• Cash, PayPal, or GCash refunds will be issued directly to the renter’s account after the vehicle has been returned in good condition, free of damage, and all penalties and charges are settled.
• Credit Card refunds can take up to 21 working days depending on the credit card, country of the renter, and the involved banks.

19. Vehicle Accessories and Equipment

If the vehicle is provided with additional accessories such as GPS, child seats, or any other supplementary equipment, the renter agrees to return all items in the same condition they were received. A charge will apply for lost or damaged accessories, including a ₱3,000 replacement fee for non-returned or damaged items.

By signing or confirming acceptance of this agreement, the renter acknowledges having read, understood, and agreed to all the terms and conditions outlined above.
